(a) When registering a trade mark, you must include a description of the goods/services you want to use your trade mark for. These goods/services are categorised into one or more classes. There are 45 different classifications of goods/services. ‘Goods’ are classified from Class 1 to 34, while ‘Services’ are classified from Class 35 to 45. Consider what goods/services you wish to designate in your application before you start the application. If you make a mistake after submitting your application, it won’t normally be able to be fixed unless you agree to reduce the scope of the goods/services.

(b) Our flat service fee covers your trade mark application only. However, there will be no extra cost until your trade mark is registered provided that IP Australia raises no objection after examination or opposition by a third party. If an objection to your trade mark registration is raised, you will have 15 months to overcome the objection. After your trade mark application is filed, we will forward to you correspondence received from IP Australia at each stage of the registration stage without an extra charge.

(c) Government fee is payable to IP Australia and is charged based on the number of classes you wish to register your trade mark. A government fee of $250 per class is applicable where your goods/services are selected using the official Pick List which includes pre-approved goods/services by IP Australia.
