  • What is trade mark?

    A trade mark is a sign that can distinguish one trader's goods and services from those of another. A trade mark can be a word, letter, number, symbol, shape, logo, design, scent, phrase, or a combination thereof. Trade marks help consumers to recognise the origin or source of the goods or services being offered.

  • Why should I register my trade mark?

    Registration of a trade mark will give you the exclusive right to use the same or similar trade mark for the designated goods and/or services. The owner of a registered trade mark may grant a third party a licence to use the trade mark.

  • When should I apply for a trade mark registration?

    There is no set timing at which you must register your trade mark. In saying that, the earlier you register, the greater your legal protection against third party infringements which can cause confusion in the marketplace and damage to your business.

  • Who should be the owner of the trade mark?

    Before applying for registration of a trade mark, you will need to decide who will be owning the trade mark. The owner may be an individual or a company, or a combination of both. A trade mark application or registration can be assigned (transferred) to a different owner later.

  • How is a trade mark different to company or business name?

    A company or business name does not grant you proprietary rights in that name. As you do not own the name, someone could obtain a very similar company/ business name and you would not be able to stop him/her from using that name.

  • How long does the trade mark registration process take?

    A trade mark is generally examined in four or five months after it has been filed with IP Australia. If the application goes smoothly, a trade mark can be registered seven and a half months after.

  • What is a designated class?

    When applying for your trade mark, you must define the goods or services associated with the use of your trade mark. Remember that your trade mark registration only grants you exclusive rights to use your trade mark in relation to the goods and services you have chosen.

  • What is a pick-list?

    When applying for a trade mark, IP Australia provides a list of pre-approved goods and services under the name of the Pick List. By selecting your goods/services from the Pick List, you are guaranteed a correct classification and avoid an IP objection to your registration.

  • Should I engage a lawyer to register my trade mark?

    Engaging a professional to prepare and file your trade marks and monitor the progress can reduce the likelihood of objections from IP Australia and oppositions from other traders against your application. Incorrect filing or filing with poor specifications may require you to re-file your application with a later filing date, increasing your costs and exposing your business to competitors registering the same mark.

  • What's the difference between the ™ symbol and ® symbol?

    The ® symbol shows that the trade mark is registered while the ™ symbol shows that the word/logo referred to functions as your trade mark, but is not necessarily registered. Note that use of the ® symbol on products in Australia may constitute an offence if the mark is not actually registered in Australia.

  • How do I enforce my rights?

    As the owner of a trade mark, you have a range of legal and enforceable rights that allow you to take action against people or companies that infringe your rights. Generally, such action starts with issuing a letter of demand requesting they cease and desist the use of your trade mark or initiate court action immediately.

  • I have not received a confirmation email of my payment.

    Within 1-2 hours of your payment, you should receive an email confirmation. Please check your junk or spam email if you haven't already.
    If you don't have a record of your payment, the payment likely was not successfully completed. Please check your account to ensure that you have been debited.

  • What forms of payment does One Click Trade Mark accept?

    We accept Visa, MasterCard, AMEX, American Express credit cards and other credit card payment through PayPal. Please be advised there will be a 3% surcharge for payments.

  • How much does it cost to file a trade mark with One Click Trade Mark?

    For each trade mark application, One Click Trade Mark charges:
    One-off fee per class: AU $580 (includes any applicable taxes and IP Australia's fixed fee of $250 per class)

  • Is the price final?

    Yes, the price is final (includes both service and administrative fees).

  • What is included in the fee?

    ✓  Services fees and any applicable taxes
    ✓  Government fees (IP Australia)
    ✓  Registration for 10 years
    ✓  Formality checks by qualified attorneys
    ✓  Expert advice throughout the registration process

  • Does the price include GST?

    The price is without GST and applies to our service fee. If you are based outside of Australia GST would not be applied.

  • Would I be able to issue a refund or a cancellation after making a payment with One Click Trade Mark?

    No, we are unable to provide you a refund or a cancellation after you have made a payment with One Click Trade Mark, unless you have been double charged due to a technical fault.

  • Would I be able to print a receipt after receiving a payment confirmation?

    Yes, as soon as you make a payment on One Click Trade Mark's website, you will have the option of receiving a 'printer friendly invoice'. Alternatively, you can print your tax invoice when we send you a confirmation email.

  • What if I cannot find my queries here or have other questions?

  • How can I change my address or notify you that my contact details have changed?

  • Can I withdraw or cancel my trade mark filing after making the final payment with One Click Trade Mark?

    Yes, you may cancel your trade mark filing, which is done only by the applicant's request and is voluntary.

  • Is it possible to register a trade mark with more than one owner?

    Yes, it is possible. If this applies to you, you have the option of adding additional applicants to your trade mark when filing through One Click Trade Mark.

  • Can I file trade marks in other countries through One Click Trade Mark?

    No, our service only provides filing your trade mark within Australia.

  • How do I enforce my trade mark after my trade mark has been filed and registered?

    Suppose you believe a third party is infringing upon your trade mark. In that case, you should seek legal advice from a registered trade mark attorney before communicating with the alleged infringer.

  • What are the risks if there are similar trade marks registered?

    If the report you received indicates similar trade marks, we highly recommend you seek legal advice from a registered trade mark attorney to ensure that your trade mark can co-exist with the similar registered trademark.

  • What happens if someone opposes my trade mark?

    You can try to oppose the opposition yourself, or you should seek legal advice from a registered trade mark attorney.

  • Does One Click Trade Mark provide trade mark watch?

    No, we do not offer continuous monitoring of trade mark registers for identical or confusingly similar third party applications, which may conflict with your trade mark.

  • Would One Click Trade Mark be sending me a reminder to renew my filed trade mark?

    Yes, we will send you a friendly reminder email that you have one year to ensure that you pay for renewal fee regarding your trade mark.
